§4 Information received by market surveillance authorities in the Safety Business Gateway

Through the Safety Business Gateway, the market surveillance authorities of the EU Member States receive information from economic operators about dangerous products they have placed or made available on the market and from providers of online marketplaces about dangerous products that have been offered to EU consumers via their online interfaces. They also receive information about accidents caused by a product made available on those interfaces. All this information is analysed by the relevant market surveillance authorities. If the national authorities find a product to be dangerous or otherwise non-compliant with the GPSR, the national market surveillance authorities take appropriate measures. If the product presents a serious risk to the health and safety of consumers, the national authorities are obliged to notify the product and the relevant measures taken through the Safety Gate Rapid Alert System. If the product presents a less than serious risk, the national authorities must, in any case, inform the Commission and may notify the product and the relevant measures through the same system.
