§9 Definition of the terms ‘permeable’ and ‘soft after-use’ in the context of compostable packaging

Legal provisions: Article 3(1) states: ‘For the purposes of this Regulation, the following definitions apply: (…) (f) a permeable tea, coffee or other beverage bag, or soft after-use system single-serve unit that contains tea, coffee or another beverage, and which is intended to be used and disposed of together with the product’. Commission’s interpretation: Article 9(1) is a material-neutral provision and could refer to permeable tea, coffee or other beverage bags, or soft after-use system single-serve units made of any material, including paper-based single-serve units. Therefore, pursuant to Article 9, such packaging must be designed for composting by 12 February 2028.
