Regulations may provide that subsection (1)(b) is not to apply in the case of agreements such as are described in the regulations, being agreements made by a particular person, if— on an application by that person to the FCA , the FCA has determined that, having regard to— the requirement imposed by subsection (1)(b) can be dispensed with without prejudicing the interests of debtors or hirers; and the manner in which antecedent negotiations for agreements with the applicant of that description are conducted, and the information provided to debtors or hirers before such agreements are made, any conditions imposed by the FCA in making the determination are complied with.
