Schedule 9B, Part 2, paragraph 3(2)

It is a defence to the charge to show that— the specimen was acquired by the person before the inclusion on the Scottish list of species of special concern of the species to which the specimen belongs, the activity to which the charge relates was not carried out after the end of the relevant period following the inclusion on the Scottish list of species of special concern to which the specimen belongs, and that activity is mentioned in sub-paragraph (3).
