Schedule 9B, Part 3, paragraph 5(2)

The appropriate authority must not grant a licence under section 16(4)(c) permitting an activity which contravenes one of the following paragraphs of that Article unless paragraph 8 or 9 applies— paragraph (e) (placing on the market), paragraph (h) (releasing into the environment).
