Section 46(2)

Subject to section 40(5), all rules of law and enactments regulating the removal or transfer of proceedings from the county court to the High Court and the transfer of proceedings in the High Court to the county court shall apply respectively to the removal or transfer of proceedings by the Crown in the county court and to the transfer of proceedings by the Crown in the High Court.
