Section 15(4)

On an application under this section to the sheriff he shall make an order setting aside the suspension notice only if he is satisfied that at the date of making the order— have not been brought or, having been brought, have been concluded. proceedings for an offence in respect of a contravention in relation to the goods of any safety provision; or proceedings for the forfeiture of the goods under section 17 below,
