An application under this section may be made— where proceedings have been brought in a magistrates’ court for an offence in respect of a contravention in relation to some or all of the goods of any safety provision, to that court; where an application with respect to some or all of the goods has been made to a magistrates’ court under section 15 above or section 33 below, to that court; and where no application for the forfeiture of the goods has been made under paragraph (a) or (b) above, by way of complaint to a magistrates’ court.
