Section 205N(2)

Where— that person shall be liable, jointly and severally with any person liable in respect of the infringement by virtue of subsection (1), as if he himself had infringed the right. there is an infringement of a right conferred by this Chapter, a person falsely claiming to act on behalf of a performer consented to the relevant conduct or purported to waive the right, and there would have been no infringement if he had been so acting,
