Section 109(1)

A person who— shall, subject to subsection (5) below, be subject to the duties specified in subsection (2), (3) or (4) below, as the case may be. is proposing to import or acquire any genetically modified organisms, or is keeping any such organisms, or is proposing to release or market any such organisms,
