Schedule 23, paragraph 4(2)

Any dispute as to whether any sum should be paid under this paragraph, or as to the amount payable, shall be referred to the arbitration of a single arbitrator appointed by agreement between the appropriate agency and the owner of the mines or minerals or, in default of agreement, by the Secretary of State.
