Section 127(3)

In determining— the appropriate agency shall have regard to the extent to which, in any year within the period proposed to be specified in the agreement as the period for which it is made, the quantity of water referred to in paragraph (a) of subsection (2) above is likely to exceed the quantity referred to in paragraph (b) of that subsection. whether to make an agreement with the applicant under this section; and the charges to be leviable under such an agreement,
