Section 129(3)

On a reference under subsection (2) above— the Secretary of State shall determine the question in dispute, having regard to the matters to which, in accordance with subsection (3) of section 127 above, the appropriate agency would be required to have regard in relation to the applicant on an application under that section; and may give directions to the appropriate agency requiring it to make an agreement with the applicant in accordance with his decision.
