Section 164(4)

Where— that person may delay his determination of the application until a reasonable time after the required information is provided. the appropriate agency, having made an application to any person for a consent for the purposes of this section, has failed to comply with its obligation under subsection (2)(a) above to supplement that application with information required by that person; and that requirement was made by that person at such a time before the end of the period within which he is required to determine the application as gave the appropriate agency a reasonable opportunity to provide the required information within that period,
