In applying sub-paragraph (1) an agreement for recognition (the agreement in question) must be ignored if— the union recognised under the agreement in question does not have (or none of the unions recognised under the agreement in question has) a certificate of independence, the union (or unions) making the application under paragraph 11 or 12 made the application before the end of the period of reflection, and the agreement in question was entered into during the restricted period.
