Section 45(6)

In any proceedings brought against a person in respect of a contravention of a requirement imposed under section 37A(3) or 37B(4) to produce documents it is a defence for him to prove— that the documents were not in his possession, and that it was not reasonably practicable for him to comply with the requirement.
