Section 63(2)

Notwithstanding anything in the rules of the union or in the practice of any court, if a member or former member of the union begins proceedings in a court with respect to a matter to which this section applies, then if— the rules requiring or allowing the matter to be so submitted, and the fact that any relevant steps remain to be taken under the rules, shall be regarded for all purposes as irrelevant to any question whether the court proceedings should be dismissed, stayed or sisted, or adjourned. he has previously made a valid application to the union for the matter to be submitted for determination or conciliation in accordance with the union’s rules, and the court proceedings are begun after the end of the period of six months beginning with the day on which the union received the application,
