Section 26A(2)

If— the authority must pay to the owner or occupier of the vessel 70% of the expenditure. before the coming into operation of the order, the owner or occupier incurs expenditure on adaptations to or in connection with the vessel to avoid the imposition of a penalty under Schedule 1A, the expenditure is incurred with the approval of the local authority given for the purpose of this section, and the adaptations are completed to the satisfaction of the local authority,
