Schedule 2A, Part 1, paragraph 2(1)

Subject to sub-paragraph (2), the proprietor of an existing EUTM may, at any time on or after IP completion day, serve notice on the registrar that the trade mark is not to be treated as if the trade mark had been registered under this Act (an “opt out notice”).
