Schedule 2A, Part 2, paragraph 23(4)

If the registration of an expired EUTM is not renewed within the time period permitted by Article 53 of the Continuing EUTM Regulation— the registrar must remove from the register the comparable trade mark (EU) which derives from the expired EUTM; and the comparable trade mark (EU) ceases with effect from IP completion day to be treated as if it had been registered under this Act.
