Schedule 2B, Part 3, paragraph 27(1)

In this Part— references to an “existing ITM application” are to an international application which contains a request for extension of the protection resulting from an international registration to the European Union under Article 3ter(1) in respect of which the conditions in sub-paragraph (2) are satisfied; references to an “existing request for EU extension” are to a request for extension to the European Union of the protection resulting from an international registration made subsequent to the international registration pursuant to Article 3ter(2) in respect of which the conditions in sub-paragraph (3) are satisfied; references to an “international application” are to an application to the International Bureau under Article 2(2) for the registration of a trade mark in the International Register.
