References in statutory provisions passed or made before the commencement of this Act to trade marks or registered trade marks within the meaning of the Trade Marks Act 1938 shall, unless the context otherwise requires, be construed after the commencement of this Act as references to trade marks or registered trade marks within the meaning of this Act. Sub-paragraph (1) applies, in particular, to the references in the following provisions—
