This section applies where on an application for the registration of a trade mark it appears to the registrar— but the applicant shows to the satisfaction of the registrar that there has been honest concurrent use of the trade mark for which registration is sought. that there is an earlier trade mark in relation to which the conditions set out in section 5(1), (2) or (3) obtain, or that there is an earlier right in relation to which the condition set out in section 5(4) is satisfied,
