Schedule 13, paragraph 12(3)

Subject to sub-paragraph (4) below, no relevant planning permission which relates to a dormant site shall have effect to authorise the carrying out of minerals development unless— an application has been made under paragraph 9 above in respect of that site; and that permission has effect in accordance with sub-paragraph (6) of that paragraph.
