Schedule 13, paragraph 6(6)

Any date specified pursuant to sub-paragraph (5)(a) above shall be a date— not earlier than the date upon which expires the period of 12 months from the date on which the applicant is notified under sub-paragraph (10) below of the mineral planning authority’s decision upon his application, and not later than the later of— the date upon which expires the period of three years from the date upon which the provisions of this Schedule come into force; and the date mentioned in paragraph (a) above.
