Schedule 13, paragraph 7(3)

In the case of— an application under sub-paragraph (1) above shall be made no later than the day upon which expires the period of three months from the day on which notice was given under paragraph 6(10) above of the mineral planning authority’s decision to add the site to or, as the case may be, so to amend the list in question. an active Phase I site— or added to the first list in accordance with paragraph 6(4)(a) above; or in respect of which the entry in the first list was amended in accordance with paragraph 6(4)(b) above; an active Phase II site— added to the second list in accordance with paragraph 6(7)(a) above; or in respect of which the entry in the second list was amended in accordance with paragraph 6(7)(b) above,
