Section 110(4)

A person guilty of an offence under subsection (1) above (except one to which subsection (3E) applies) shall be liable— in the case of an offence of assaulting, hindering or obstructing an authorised person in the execution of his powers under section 109 above— on summary conviction, to a fine not exceeding the statutory maximum or to imprisonment for a term not exceeding 12 months, or to both; on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years, or to both; in any other case, on summary conviction, to a fine not exceeding level 5 on the standard scale the prescribed sum within the meaning of section 225(8) of the Criminal Procedure (Scotland) Act 1995 or to imprisonment for a term not exceeding 12 months, or to both.
