Section 110(5E)

A person guilty of an offence under subsection (3B) is liable— on summary conviction, to a fine or to imprisonment for a period not exceeding the general limit in a magistrates’ court, or to both; on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years, or to both.
