The questions— shall be determined in accordance with guidance issued for the purpose by the Secretary of State in accordance with section 78YA below. what harm is to be regarded as “significant”, whether the possibility of significant harm being caused is “significant”, whether pollution of controlled waters is being, or is likely to be caused,
