But section 55 does not apply to any disclosure of information of the kind referred to in sub-paragraph (1) if the disclosure is made— for the purpose of facilitating the performance of functions of a designated person under the Control of Misleading Advertisements Regulations 1988; or for the purposes of any proceedings before the Court or of any other legal proceedings under the RTPA or the Fair Trading Act 1973 or the Control of Misleading Advertisements Regulations 1988.
