Section 12(3)

The Secretary of State may by regulations make provision as to the application of sections 13 to 16 and Schedule 5, with such modifications (if any) as may be prescribed, in cases where the OFT— has given a direction withdrawing an exclusion; or is considering whether to give such a direction.
