Section 47B(5)

The Tribunal may make a collective proceedings order only— if it considers that the person who brought the proceedings is a person who, if the order were made, the Tribunal could authorise to act as the representative in those proceedings in accordance with subsection (8), and in respect of claims which are eligible for inclusion in collective proceedings.
