Schedule 13, Part IV, paragraph 11(5)

A person guilty of an offence under sub-paragraph (3)(b) is liable— on summary conviction, to a fine not exceeding the statutory maximum; on conviction on indictment, to imprisonment for a term not exceeding two years or a fine or both.
