Section 137FBC(4)

The list must not include a scheme or arrangement if— the notice in relation to it has been withdrawn by the provider of the scheme, or the FCA has determined that it is unlikely that rules made under subsection (1) or (2)(a) will be complied with in relation to the scheme or arrangement within such period as the FCA considers reasonable.
