The FCA may refuse an application under section 271A if it appears to the FCA that the operator of the scheme— has contravened a requirement imposed on them by or under this Act, or would contravene such a requirement if the application were granted, or has, in purported compliance with such a requirement, knowingly or recklessly given the FCA information which is false or misleading in a material particular.
