In a case where no notice of intention to appoint is required— subsection (3)(b) shall not apply, but consent under subsection (2) must accompany the notice of appointment filed under paragraph 29 of Schedule B1 to the 1986 Act or paragraph 30 of Schedule B1 to the 1989 Order.
