Section 409B(9)

The condition referred to in subsection (8)(a) is that the FCA considers it necessary not to comply with the requirement imposed by subsection (2) for the purpose of advancing— the consumer protection objective, or if an order under section 137D(1)(b) is in force, the integrity objective.
