In section 58 (access to legal advice) for subsection (8A) substitute— An officer may also authorise delay where he has reasonable grounds for believing that— the person detained for the serious arrestable offence has benefited from his criminal conduct, and the recovery of the value of the property constituting the benefit will be hindered by the exercise of the right conferred by subsection (1) above. For the purposes of subsection (8A) above the question whether a person has benefited from his criminal conduct is to be decided in accordance with Part 2 of the Proceeds of Crime Act 2002.
