If— the confiscation order is to be treated for the purposes of this section as if it were a recovery order obtained by the enforcement authority in respect of the property referred to in paragraph (a). property has been taken into account in deciding the amount of a person’s benefit from criminal conduct for the purpose of making a confiscation order, and the enforcement authority subsequently seeks a recovery order in respect of related property,
