Section 362E

A person commits an offence if, in purported compliance with a requirement imposed by an unexplained wealth order, the person— makes a statement that the person knows to be false or misleading in a material particular, or recklessly makes a statement that is false or misleading in a material particular. A person guilty of an offence under this section is liable— on conviction on indictment, to imprisonment for a term not exceeding 2 years, or to a fine, or to both; on summary conviction in England and Wales, to imprisonment for a term not exceeding the general limit in a magistrates’ court, or to a fine, or to both; on summary conviction in Northern Ireland, to imprisonment for a term not exceeding 6 months, or to a fine not exceeding the statutory maximum, or to both. In relation to an offence committed before 2 May 2022, the reference in subsection (2)(b) to the general limit in a magistrates’ court is to be read as a reference to 6 months.
