Section 67J

If, on an application under section 42 for a restraint order, the Crown Court decides not to make one, the person who applied for the order may appeal to the Court of Appeal against the decision. If an application is made under section 42(3) in relation to a restraint order or an order under section 41(7), the following may appeal to the Court of Appeal in respect of the Crown Court’s decision on the application— the person who applied for the order; any person affected by the order. On an appeal under subsection (1) or (2) the Court of Appeal may— confirm the decision, or make such order as it believes is appropriate. An appeal lies to the Supreme Court from a decision of the Court of Appeal on an appeal under this section, at the instance of any person who was a party to the proceedings before the Court of Appeal. On an appeal under subsection (4) the Supreme Court may— confirm the decision of the Court of Appeal, or make such order as it believes is appropriate.
