Schedule 10, paragraph 3(1)

If, after giving notice under paragraph 2(1) or (4), the relevant authority decides— the relevant authority shall give notice of that decision. not to accept the undertaking concerned or (as the case may be) make the order concerned; and not to proceed by virtue of paragraph 5;
