The members appointed as President or as chairmen shall hold and vacate office in accordance with their terms of appointment, subject to the following provisions. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . The President and the chairmen may resign their offices by notice in writing to the Lord Chancellor. The Lord Chancellor may remove a person from office as President or chairman on the ground of incapacity or misbehaviour. The Lord Chancellor may remove a person from office as President under sub-paragraph (4) only with the concurrence of all of the following— the Lord Chief Justice of England and Wales; the Lord President of the Court of Session; the Lord Chief Justice of Northern Ireland. The Lord Chancellor may remove a person from office as chairman under sub-paragraph (4) only with the concurrence of the appropriate senior judge. The appropriate senior judge is the Lord Chief Justice of England and Wales, unless— the person to be removed exercises functions wholly or mainly in Scotland, in which case it is the Lord President of the Court of Session, or the person to be removed exercises functions wholly or mainly in Northern Ireland, in which case it is the Lord Chief Justice of Northern Ireland.
