Section 140A(1)

This section applies where— the CMA has prepared a market study report in relation to a matter within the period permitted by section 131B(4); an intervention notice under section 139(1) is in force in relation to the matter at the time when the CMA would (but for this section) be required to publish the report; and the report contains the decision of the CMA that it should make an ordinary reference or a cross-market reference in relation to the matter under section 131.
