Section 143

This section applies in relation to a report prepared under section 142 in respect of a restricted PI reference. The CMA shall publish the report if it contains— the decision of the CMA that there is no adverse effect on competition; or the decisions of the CMA that there is one or more than one adverse effect on competition but, on the question mentioned in section 141(4)(a) and in relation to each adverse effect on competition, that no action should be taken by it. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Where the report contains the decisions of the CMA that there is one or more than one adverse effect on competition and, on the question mentioned in section 141(4)(a) and in relation to at least one such adverse effect, that action should be taken by it, the CMA shall give the report to the Secretary of State.
