In this section and section 158— “pre-emptive action” means action which might impede the taking of any action under section 138(2) , 147(2) or (as the case may be) 147A(2) in relation to the market investigation reference concerned; and “the relevant authority” means— in the case of a restricted PI reference or a full PI reference, the Secretary of State; in any other case, the CMA.
