Section 34ZA(1)

In carrying out its function of deciding whether to make a reference under section 22(1) or 33(1), the CMA shall, within the initial period— decide whether the duty to make a reference under the subsection applies (taking account of the power under section 22(2) or (as the case may be) 33(2) and the operation of section 22(3) or (as the case may be) 33(3)); and inform the persons carrying on the enterprises concerned by notice of the decision and of the reasons for it.
