Section 35(1)

Subject to subsections (6) and (7) and section 127(3), the CMA shall, on a reference under section 22, decide the following questions— whether a relevant merger situation has been created; and if so, whether the creation of that situation has resulted, or may be expected to result, in a substantial lessening of competition within any market or markets in the United Kingdom for goods or services.
