Schedule 3, Part 3, paragraph 9(2)

That power may only be exercised to make an Order in Council— that extends or applies both to Scotland and to one or more of England, Wales and Northern Ireland, or that extends to Scotland only and contains both provision within the legislative competence of the Scottish Parliament and provision outside that competence.
