“Protected items” means— communications between a professional legal adviser and that adviser’s client or any person representing such a client which fall within subsection (3), communications between a professional legal adviser, that adviser’s client or any person representing such a client and any other person which fall within subsection (3) (as a result of paragraph (b) of that subsection), and items which— are enclosed with, or referred to in, such communications, fall within subsection (3), and are in the possession of a person entitled to possession of them.
